FTC Unveils New Guidelines to Combat Fake and Misleading Product Reviews

The Federal Trade Commission (FTC) has announced new guidelines aimed at tackling fake, misleading, and AI-generated product reviews. These regulations grant the FTC the authority to impose civil penalties on individuals and entities posting deceptive reviews, marking a significant step towards cleaning up the online review space for American consumers.

The comprehensive guidelines prohibit a range of abusive tactics in product reviews, including the use of generative AI tools to create fake testimonials, attributing reviews to non-existent individuals, and misrepresenting expertise in reviews. This move comes in response to recent controversies, such as the case of AdVon Commerce’s AI-generated reviews and the use of fake authors and profiles in media outlets like Sports Illustrated and The Miami Herald.

A key focus of the new rules is addressing reviews by non-existent or inexperienced individuals and the misrepresentation of experiences in testimonials. The FTC is also cracking down on the practice of purchasing positive or negative reviews, including buying social media followers. Additionally, intimidation tactics used to suppress critical reviews will now be punishable under these guidelines.

The regulations also target “insider reviews” and undisclosed connections between reviewers and companies. For instance, the guidelines prohibit undisclosed material connections in reviews, citing an example of a tire company reviewing its products without proper disclosure.

These new rules could have significant implications for media companies. AdVon Commerce, for example, may face scrutiny for potential guideline breaches, including the operation of Seller Rocket for undisclosed pay-to-play reviews and a lack of transparency in media-produced product reviews.

FTC Chair Lina Khan emphasized the importance of these guidelines, stating, “Fake reviews waste consumers’ time and money, and harm honest businesses. The FTC is committed to maintaining a fair marketplace where consumers can make informed decisions based on truthful information.”

As these new guidelines take effect, businesses and individuals involved in product reviews will need to ensure compliance to avoid potential penalties and maintain consumer trust in the online marketplace.
